A Texas man says Progressive Insurance offered an injured pedestrian just $5,000 after a car accident left him with a severely broken leg. After the man rejected the offer and hired an attorney, they eventually settled the case for $200,000.
On Oct. 29, an insurance lawyer (@loewylaw) shared the case details and nuances on TikTok.
What happened with this Progressive insurance claim?
He says the incident happened when a man jogged through a residential subdivision. As he crossed the street, an elderly woman allegedly drove into him without seeing him. The impact sent the pedestrian rolling over the woman’s windshield, which shattered during the collision, leaving him with a broken leg.
The injured man initially contacted the attorney, who believed he had a strong case. However, the man never signed the attorney’s contract and stopped responding to his calls. Four months later, he reached out again to discuss his case. He explained that he had attempted to negotiate directly with Progressive Insurance.
He says the company offered him $5,000 to settle his injury claim. “$5,000 for a severely broken leg?” the attorney recalled asking the man. “I said, does that sound like a good deal?”
The man reportedly rejected the offer and expressed frustration with the insurance company’s proposed settlement. The attorney then agreed to take the case. They filed a lawsuit and eventually secured a $200,000 settlement. “So the insurance wanted to pay $5,000,” the attorney said. “We got $200,000.”
He used the case to encourage accident victims to seek legal representation before accepting an insurance company’s settlement offer. “Always, always hire a lawyer when you’re dealing with an insurance company on an injury claim,” he advised.
The attorney argued that insurance companies prioritize protecting their profits rather than maximizing payouts for injured people. “They’re gonna lowball you,” he said. “And us lawyers add value.”
Are there regulations preventing insurance companies from unfair settlement practices?
Texas law does prohibit insurance companies from engaging in certain unfair settlement practices. However, that doesn’t mean every low settlement offer violates the law.
Texas Insurance Code states that insurers must attempt to reach prompt, fair, and equitable settlements when liability becomes reasonably clear. The law also prohibits insurers from misrepresenting coverage and refusing to investigate claims properly.
Additionally, the Texas Insurance Code prohibits insurers from knowingly misrepresenting coverage, failing to investigate claims promptly, and refusing to negotiate fairly when liability becomes reasonably clear. The statute also addresses insurers that force policyholders to sue by offering substantially less than they ultimately recover.
Does hiring a lawyer really help with unfair settlement practices?
While hiring an attorney can help accident victims negotiate with insurers, research suggests legal representation does not always produce better financial outcomes.
A July 2026 Insurance Research Council study examined more than 7.4 million auto injury claims. Researchers found that represented bodily injury claimants received $1.40 for every dollar of medical expenses after estimated legal fees. Unrepresented claimants received $1.80. Represented claimants also waited a median of nearly 440 days for settlement, more than twice as long.
That said, those averages don’t account for every individual case. An attorney may help someone with serious injuries identify damages and challenge an inadequate offer.
